La “Avocación” de competencias sanitarias y de salud pública por la Unión Europea durante la pandemia causada por el Coronavirus SARS CoV 2

Resumen

La ausencia de un esquema funcional que delimite de manera apropiada las competencias de la Unión Europea y de los Estados miembros en materia de salud pública y asistencia sanitaria ha provocado continuos y graves problemas para el desarrollo de un modelo armónico. Han tenido que ser las crisis, y muy especialmente la pandemia causada por el coronavirus SARS-CoV-2, las encargadas de poner de relieve cómo los lazos europeos son muy sensibles a una reacción rápida y coordinada en estos ámbitos vitales. Así, y a partir de decisiones sobre fronteras exteriores e interiores, gestión de asistencia sanitaria transfronteriza, suministros de productos sanitarios o, sobre todo, financiación de los sistemas naciones de salud, la Unión Europea recupera un protagonismo que el principio de subsidiariedad le había cerrado. ¿Hasta dónde y hasta cuándo la solidaridad?
