Religious Neutrality and Labour Discrimination against Minorities

In the EU, the principle of non-discrimination is regulated, inter alia¸ in Directive 2000/78. In prohibiting discrimination in employment on grounds inherent to the values on which the Union is founded, Directive 2000/78 presupposes that equal access to employment is a paramount requirement for social and personal development of individuals, and thus for an increase in the standards of living. Its high standards of protection have not, however, managed to prevent the CJEU from construing a jurisprudential saga that legitimises the assimilation, or even the exclusion, of minority workers who refuse to conform to the intolerant wishes of the majority society. This article aims to reflect on and show to what extent the EU is committed to its objective of realising an inclusive market in which equality prevails.
