Abstract

The U.S. federal minimum wage legislation considers that certain employment relationships should be exempt from its application. There is some debate as to the standard of evidence for such exempt employment relationships. The United States Supreme Court opts for the preponderance of the evidence standard, which favors the employer’s position, in front of the clear and convincing evidence standard.
