The Judgment of the Supreme Court dated 14 January 2025 (Case No. 963/2024), which is the subject of the present commentary, examines the impact of reduced working hours due to the care of a child under the age of twelve on the entitlement to salary supplements. In this ruling, the Court reiterates the established judicial doctrine that distinguishes between those salary supplements which must be reduced proportionally in accordance with the reduction in working time, and those whose nature bears no direct relation to the duration of the working day. The judgment also underscores the need of of apply a gender perspective in the interpretation and implementation of the remuneration framework in such cases, in order to prevent potential instances of indirect discrimination against women, who represent the majority of individuals exercising this right to reconcile work and family life.
The Labour Chamber confirms that the shift allowance constitutes a salary supplement intended to compensate for the hardship associated with working in rotating shifts. As it is not linked to the number of hours worked, this supplement must be paid in full in cases where the employee, despite having reduced their working hours, remains subject to the shift system.
