Within the framework of the amendments introduced by the U.S. federal Sarbanes-Oxley Act of 2002 to improve the protection of whistleblowers, especially in the face of retaliation, as in the case they are fired, the Supreme Court of the United States clarifies the level of proof required of a retaliated employee, who is then a plaintiff before the federal Courts, in order to shift the burden to the employer. At stake, in the specific case before the Supreme Court, is an award of damages suffered by the employee of many hundreds of thousands of dollars. An award whose amount is very surprising in comparative law, if analyzed from our Spanish perspective.
