The procedural method of protection of fundamental rights and public freedoms in the social jurisprudence of the Supreme Court

The 2011 Law Regulating Social Jurisdiction devotes its articles 177 to 184 to establishing the specific legal regime for the procedural modality of protection of fundamental rights and public freedoms when these are impaired within the framework of an employment relationship.
The legal architecture of this procedural modality, while presenting significant advances in relation to its regulatory precedents, is not free from uncertainties, gray areas, and application problems, which have been resolved through the pronouncements and criteria of the courts. A prominent role in this integrative work of the insufficient regulatory framework that addresses the reinforced jurisdictional guarantee of fundamental rights in the social sphere has fallen to the jurisprudence of the Fourth Chamber of the Supreme Court, both through the ordinary appeal for cassation and the appeal for cassation for the unification of doctrine. The purpose of these pages is to expose and vindicate the decisive participation of this high court in the legal configuration of an institution so important to our labor relations.
