Supreme Court Judgment No. 793/2025 of 15 July: Additional Compensation in Cases of Unfair Dismissal and Conventionality Control

Abstract

The Social Chamber of the Supreme Court confirms the judgment delivered by the Catalan Chamber, stating that in cases of unfair dismissal, the judge should not assess an additional compensation over the statutory amount, as the interpretation rendered by the European Committee of Social Rights regarding the inadequacy of Article 56 of the Workers’ Statute (ET) in relation to Article 24 of the European Social Charter does not have prevailing force.
