Abstract

Directive 2000/78/EC is one of the most important European regulations in the labor law sphere, as it aims to offer harmonized protection against discrimination in employment, and it covers a wide range of situations. However, over the years alleged limits have progressively appeared, which, through preliminary rulings, have allowed the Court of Justice of the European Union to reaffirm an expansive scope of application.
Thus, this judgment commentary analyzes the Judgment of the Court of Justice of the European Union of 2 June 2022, HK Danmark and HK Privat, C587/20, ECLI:EU:C:2022:419, which deals with a case of possible age discrimination in the re-election of a person as president of an organization of working people, and highlights an actual debate about the limits on the subjective scope of Directive 2000/78/EC.
