The employment of platform workers in Germany, in the light of current developments

Abstract

This paper addresses the issue of whether people who work in platforms can be employees. In this sense, it studies before all the German concept of employee, making a special assessment of a Federal Labor Court decision about the crowdworking. The taking into consideration of the European Union Law is added, both with respect to the EUCJ Yodel case and the Directive draft made for improving employment conditions of workers in platforms. Furthermore, the relationship between the national and European concepts of employee is discussed.
