The territorial jurisdiction of the Labour Courts in cases of teleworking: priority of application of the general rule or of the special rule?

The territorial jurisdiction of the Social Courts in cases of telecommuting has not been specifically addressed in the LRJS despite various opportunities following different legislative reforms.
In this context, this commentary aims to analyze judgment 1154/2023 of December 15, 2023, from the Social Chamber of the TSJ of Madrid, regarding the determination of territorial jurisdiction in claims filed by telecommuters. This analysis will be carried out alongside other judicial pronouncements that adopt a completely opposite criterion.
Therefore, an exhaustive study will be carried out of the judicial ruling of the TSJ of Madrid, which deviates from the line maintained until now by precedents available on the matter. Finally, an attempt will be made to indicate and specify what the territorial jurisdiction of telecommuters based on the interpretation of Article 5 and 10 of the LRJS, as well as the Third Additional Provision of Law 10/2021 of July 9, on remote work.
