Abstract

State Budget Law (2008) amended the Mutual Societies colaboration scope in the management of benefits derived from occupational disease. At first, Mutuas challenged the admnistrative resolutions that imposed them the responsibility for the payment of such benefits for events caused after 1-1-2008 when the worker had not developed after that date activity risk of occupational disease. The Supreme Court jurisprudence (2013) imputing responsibility to the National Institute of Social Security has resulted that Mutual request the return of capital cost constituted for payment, now turning against firm decisions. The question is whether it should apply to mutuals article 71.4 Social Jurisdiction Act.
