Abstract

This study analyzes the Supreme Court of Justice of Murcia (STSJ) ruling 275/2025, dated March 7, in which the aforementioned court adopted the Supreme Court’s doctrine to determine that there is a presumption of occupational hazard in the cause of death of a worker who was found lifeless at home the day after showing symptoms consistent with the cerebral hemorrhage reflected in his autopsy at the end of his shift. It has been considered that the cause could have been related to this prior deterioration of his health and, in addition, emphasis has been placed on the lack of sufficient evidence to rule out that working conditions, e.g., prolonged exposure to heat and severe physical exertion, were part of the relevant event that could have influenced the event that caused his death.
