Abstract

This paper commemorates the 50th anniversary of the Social Security landmark case Weinberger v. Wiesenfeld, decided in 1975 by the United States Supreme Court, on death and survivor benefits for child in care. On the one hand, from a synchronic perspective, it represented then an important step forward in the fight for equality and against gender discrimination; on the other hand, from a diachronic perspective, it would easily fit today into the categories of discrimination by association and reverse discrimination. Let us pay tribute to the contribution of attorney Ruth Bader GINSBURG to the legal victory in favor of the beneficiary in this case, remembering her own words.
