Abstract

The Judgment of the Supreme Court of 27 November 2024 [ECLI:ES:TS:2024:6099] held that two Total Permanent Disability (TPD) pensions arising successively under different schemes may be compatible, even where some of the contributions used to calculate the first pension were made under the same scheme as the second. This commentary summarises the Court’s reasoning and sets out the precedents and legal context that have supported the new interpretation of Royal Decree 691/1991. In particular, it highlights the Judgment of the Court of Justice of the European Union of 30 June 2022 (Case C-625/20), which opened the possibility for surrounding social factors—such as the greater difficulty faced by women in engaging in multiple employment—to be taken into account in adjusting the current rules on compatibility of benefits and reciprocal aggregation of contributions, the reform of which is becoming increasingly necessary.
