Abstract

In this study, we consider if it exists the compatibility between unemployment benefit and work "especially self-employment". Our starting point is the consolidated criterion of the case law, which stipulates the general rule of the absolute incompatibility.

However, from a current case law study, we observe the existence of certain compatibility cases, a fact that allows us to confirm that the general rule of incompatibility is not as absolute as it seemed to be.

With this objective, we begin analysing the recent judgement of the Supreme Court dating from April 5th 2017; continuing with a collection of the case law "about recent and not so recent judgements" in which we observe a change of model from the absolute incompatibility to the more than desirable compatibility, what makes us confirm the obsolescence of the 282 LGSS article and its necessary revision and reform in order to stop declaring incompatible what is perfectly compatible: the unemployment benefit with the self-employment.

Additionally, we make a present and extensive assessment of the right to the unemployment protection, the employment policies and, in general, the Social Security.
