Abstract

In this study, the resolution adopted in the sentence which is subject to comment is analysed from a critical point of view. On the one hand, the function of the appeal for reversal for doctrine unification is addressed as a possible reason for not admitting the requests for benefits for cessation of activity to be processed, within the very framework of the Supreme Court. On the other hand, the function of the temporary disability subsidy as a substitute for employment income due to the inability to work and the importance of this function for the purposes of the issue at stake in the aforementioned sentence is analysed.
