Abstract

The Contentious-Administrative Chamber of the Supreme Court recognises the right to collect a widow's pension of both wives of a polygamous Moroccan citizen who served for the Spanish army in the Sahara, and who received a payment from the Spanish State, under the provisions of article 23 of the Agreement on Social Security between Spain and Morocco, of 8 November 1979. In terms of the distribution of the pension, it is established that the pension must be distributed equally between the two widows. Our highest Court has cleared up the doubts that existed to date. Although polygamy is against Spanish law, when the State signs an international agreement with another country where such a marriage is recognised, their provisions must be complied with.
