Probably one of the least doctrinally treated aspects is the one mentioned in the title of this study, which is developed below, despite the fact that its practical application highlights that it causes substantial turmoil among citizens. The legal conclusions and the judicial doctrine also reflect the important role that assigned interpretive and complementary functions play in its legal design. We are, then, as is shown below, dealing with an institution in which living Law has a wide margin of action.
