Financial assistance for the care of children affected by a serious illness in cases of separation or divorce of the parents
Abstract
This article analyses the ruling of STS 3148/2021, of 20 July. The debate focuses on whether the care allowance for a seriously ill child received by a divorced mother who has custody of her daughter with a serious illness ceases when the other parent is no longer in employment. It is noteworthy that the requirement for both parents to be affiliated and registered with a public social security scheme, even in the case of separation or divorce when only one of them has custody of the child, is a situation that has been used frequently, especially by the Mutual Companies Collaborating with Social Security, both to deny access to the allowance and to terminate the allowance already paid. It is therefore of interest to review the existing case law on the matter, the aim of this article being to analyse this issue, paying special attention to the latest pronouncement of the Supreme Court on the matter.
