Abstract

Law 21/2021 of 28 December addresses a first set of pension reform measures at a complex time following the difficult economic situation caused by the COVID-19 pandemic. Among many other measures, this law includes a new amendment to the rules on the revaluation of contributory pensions. Consequently, following the law’s enactment, these pensions will be revalued at the average value of the percentage change in the CPI for the twelve months prior to December of the previous year. This new provision involves abandoning the quasi-freezing of pensions that the previous regulation implied and moving closer to the objective of maintaining purchasing power, leaving the sustainability of the social security system as the axis on which the revaluation of pensions is based in the background. The reverse side of this improvement in pensioners’ rights is the increase in expenditure that comes with it. The new rule, however, does not fully ensure that the purchasing power of contributory pensions is maintained. Furthermore, the soaring cost of pensions has raised new doubts and opinions against the new pension revaluation approach.
