Abstract

An ONCE worker with vision problems before affiliation with Social Security requests the recognition of major disability after their dismissal, at which time they are recognised as being completely blind. The Social Security Administration denies them the benefit that is judicially recognised in the instance, but, again, withdrawn in supplication. The Supreme Court, following its doctrine, pronounces the sentence and grants the major disability. However, a new ruling by the same Court later in time has shaken the foundations of the ratio decidendi.
