Abstract

The judgement of the Fourth Chamber of the Supreme Court 419/2023, of 13 June 2023 (appeal no. 1549/2020), decides whether a person applying for the benefit under Article 226.2 of the LGSS has the right to receive it, considering that their situation at the time of the qualifying event was one of de facto separation after having been a victim of gender-based violence, a requirement not explicitly listed in the article, which stipulates legal separation as a qualifying condition. On appeal, the claim was dismissed due to the legal requirement not being met at the time of the qualifying event. It was understood that extending the scope of this benefit to the circumstances of the case would exceed the application of the rules, which prompted the filing of an appeal for the unification of doctrine. Finally, the Supreme Court rules in favour of the applicant, recognising their right to the benefit. The Court considers the de facto separation established within the context of gender-based violence in the case, aligning with the principles governing legislation against such violence.
