A recent ruling by the Supreme Court’s Social Chamber plenary has announced a change in doctrine regarding the compatibility between permanent absolute disability or severe disability pensions and employment, in this case with selling lottery tickets for ONCE, which until now was considered permissible under settled case law. The Court bases its reasoning on a literal and systematic interpretation, along with the social reality of the moment, now establishing the incompatibility of these pensions with habitual work and regular income. This article contrasts the previous situation, where receiving a permanent absolute disability pension and working was allowed by abundant case law, with the new doctrine established by the Supreme Court.
