Abstract

The Supreme Court for Unification of Doctrine ruling of February 20, 2024, recognizes the right to a widow’s pension for a woman victim of gender-based violence who does not receive a compensatory pension and does not meet the requirements established in the 18th Transitional Provision of LGSS-94. The Court considers that the mentioned Transitional Provision refers to a limited time frame and does not specifically mention the case of separated or divorced women who are victims of gender-based violence.
