Abstract

The article offers a critical analysis of Directive (EU) 2024/2831 on platform work, based on its text and the Report of the Group of Experts, identifying areas of ambiguity that are relevant for its transposition into Spanish law. It examines four central pillars (scope of application, presumption of employment status, algorithmic management, and reporting and information obligations) and shows how certain interpretations by the Commission tend to restrict the Directive’s protective potential. On this basis, it proposes interpretative guidelines for a Spanish transposition that strengthens the link between employment and social security and ensures effective protection for those working on digital platforms.
