Abstract

The legal regime of permanent disability in Portugal presents a duality between the common risk protection regime and the professional risk protection regime. This dualism is immediately foreseen in the constitutional and legal rules and norms that have been developed by those constitutional provisions which are, on the one hand, the social security standards strictly speaking, and on the other hand, the provisions for the development of the labour code. In Portugal, the protection for permanent disability, if caused by common risks, it presents similarities and differences with the one resultant from occupational risks in conceptual terms of the contingency, definition of degrees, benefits, procedure for the declaration of disability and granting of benefits, as well as regarding the jurisdictional litigation.
