Abstract

The compensation for non-material damage arising from workplace accidents is a topic that has been addressed by French jurisprudence for many years. The final word on this matter from the French Court of Cassation is contained in a recent decision pronounced by this Court on 14th December 2017, which was described by the Court of Cassation itself as a judgment with high doctrinal value. In such decision, a matter of considerable comparative importance is analysed, namely the proof of the causal relationship between the workplace accident and the non-material damage caused by such accident to an orphan of the worker who suffered it.
