Abstract

The paper sets out to analyse the series of administrative and Social Security liabilities in occupational health and safety matters. First of all, we will provide an overview of health and safety liabilities. We will then address the critical aspects posed by these liabilities. In their interaction, we will indicate how the administrative liability has a core character and the Social Security liability has a procedural character with respect to the former. We will focus on the employer as the main liable party, as they are fully aware of the source of hazards and risks. We will analyse guilt as a key element in both liabilities, and its own characteristics that make it a "quasi-objective" liability.
