Abstract

The purpose of this comment is to analyse the disability pension in its non-contributory modality, established by Law 26/1990 of 20 December, in light of the doctrine of the Supreme Court of 17 January 2011. The Cassation Appeal for Doctrine Unification analyses whether the maintenance of inmates in penitentiary establishments is a benefit resource for the purposes of article 144.5 of the General Social Security Act.
