Abstract

Criticism of the Spanish regulation of the Social Security administrative claim prior to judicial review, if it aims to be substantiated with compelling reasons, requires finding an effective comparative benchmark. That benchmark is found in the regulation of the subject existing in the United States. The chosen comparative benchmark allows for a debate on the advantages and disadvantages stemming from whether the legal nature of the Social Security administrative claim prior to judicial review is “contentious,” as is the case in Spain, or instead “inquisitorial,” as it is in the United States, as decisively affirmed by federal American case law on Social Security law governing the matter.
