In recent years, there have been several rulings issued by our Courts questioning the possibility of recognizing permanent disability to those people who at the time of their application were enjoying early retirement due to disability, on the understanding - and this is reflected in various rulings - that this would imply a kind of double positive discrimination. On this basis, and in accordance with the requirements of art. 195.1 LGSS, the Supreme Court had understood that it was not possible to recognize the permanent incapacity of such persons since we were certainly faced with a situation of early retirement, but in any case with an ordinary retirement depending on their specific circumstances. This controversial doctrine was subsequently dismantled by various rulings of the Constitutional Court, which recognizes the existence of unjustified discrimination against persons with disabilities. On the basis of this jurisprudential review, an analysis will be carried out of the state in which this issue is currently located following the recent ruling of the Supreme Court of 27 April 2022, where it makes a change in the doctrine that has been followed until now.Descargas
