Novation of pre-retiremet agreements to access more beneficial retirement

The lack of legal recognition of pre-retirement has been moving to the judiciary controversies. This study examines the viability of the novation pre-retirement agreements as a result of reforms in the retirement pensions regulations. The impact on amount of pensions causes rejection of Social Security. However, excluding the fraud law application, any objection raised by the modification of the initials agreements. But in the STS 18 mar.14, Ar. 2254 deserves special attention the indiscriminate application of two rules regulators of early retirement.
