Abstract

This paper analyzes the doctrine established by the spanish Supreme Court on recognition of maternity benefit in the case of a gestation contract by substitution (surrogacy maternity), and more specifically when the applicant is the biological and registered father who, once the childbirth has taken place, assumes alone the rising children.
