Abstract

The unemployment allowance shall be for reinstatement in the amount perceived as wages processing. Between two possible solutions, namely, the full return of the benefit or only that portion concurrent with the period and the amount of wages processing, the courts have chosen for the latter. Even they have been more flexible still, considering not so much the quantity of the wages of processing that the worker must perceive but the really perceived one. However, circumstances such as a business decision not adjusted right it is an unfair or null dismissal, the new rules of compatibility between benefits and work and, especially, the fact that the indemnification is compatible with the unemployment should, allow further relativizing the solution reached.
