Abstract

er LGSS article 221.1, currently 281.1 in the new law, unemployment protection is explicity incompatible with the work and, consecuently, with employment income. However, it's necessary to distinguish clearly between "employees" and the independant "self-employed", and the most important thing: the significance or relevance of these activities. In this respect, it was confirmed the existence of compatible alleged because of little importance of the economic income. At the same time, in others similar situations without important employement income, if the recipient of the unemployement allowance doesn't notify to the SPEE the start of a employment relationship, the essential thing is not the income obtained, but rather the non-compliance with his legal obligations.
