Since the passing of the RD 2621/1986, 24th December, the railway sector workers have been one of the collective inside the Spanish Social Security system, which have been entitled to receive the ordinary retirement pension at younger age due to the unhealthy or dangerous nature of their activity. However, this social measure has not been unaware of the reforms, which, especially in the last decade, had tried to limit the anticipated access to the retirement pension "in order to warrant the financial viability of the system. This has contributed to form the regulatory framework in which the previous mentioned social action is currently developed. Therefore, regarding this regulatory framework, this paper analyzes the last Supreme Court pronouncement on the application of reduction coefficients of the usual scheduled retirement age, for some professional categories of railway sector workers, by article 3.1 RD 2621/1986.Downloads
