Abstract

The ruling issued by the Social Security Chamber of the Supreme Court on 7 November 2018 establishes the criterion which, in the event of a beneficiary of unemployment benefit for ex-offenders, this person must be deemed as registered with the Social Security for the purposes of establishing the possible right of their children to an orphan's pension. According to the ruling, the assessment of the reasons why the deceased did not appear as a jobseeker for a significant period of time is inconsequential. It presumes that the origin of the breach of obligations by the deceased is in the time of imprisonment.
