Abstract

This paper uses judicial and jurisprudential principles to study the configuration of working time in order to delimit effective working time, thereby addressing the controversy on availability times, especially standby times at home, as well as whether time spent by the workers is part of that concept and, therefore, should be considered as effective working time. In particular, when it comes to the trip between the worker's home and their first daily client, as well as the trip between the location of the final user of the day and the worker's home in the event of workers who provide home services. Likewise, its aspect is analysed from the consideration of workplace accidents and related to the new company obligations to register the working day and respect the right of workers' digital disconnection.
