Abstract

The collective bargaining reform pushed during the years 1994 and 1997 has been one of the most debated issues in a doctrinal and jurisprudential way. Proof of this is the work published, in 2001, by Professor Efrén Borrajo Dacruz in the magazine Actualidad Laboral that he directed. With a certain mastery and critical study, Professor Borrajo Dacruz shows the friendliest, but also darkest side of the mentioned reforms, thus accounting for the tremendous conflict that occurs in the judicial arena sometimes unnecessarily. One of the questions that Professor Borrajo Dacruz questions the most is the one related to the opportunism of the modifications, because this has resulted in a significant setback in the regulation of Title III of the Workers’ Statute.
