Abstract

Non-contributory pensions constitute a subjective right of citizens that is not at the mercy of the administration in office, which means that they are judicially enforceable by those who meet the conditions for receiving them. In relation to the requirement of lack of income, in the last two decades there have been judicial pronouncements clarifying that due to the very purpose of non-contributory pensions, rights that are not being incorporated in a real way into the applicant’s assets for reasons beyond his or her control should not be taken into account. Despite this, some rulings have continued to appear denying access to these pensions, in situations related to beneficiaries of contributory pensions from the Venezuelan Social Security system, although it is publicly and manifestly known that these residents in Spain have not been receiving them since 2016. This is the debate that the STS 18 October 2022 aims to close.
