Officialdom principle in the provision of temporary disability. Prescrición and expiry of Social Security benefits

Abstract

The Supreme Court judgment de la Social Chamber of 7 July 2015 (JUR \ 2015 \ 189347), returns to rule on the birth of a social security benefit, in this case the temporary disability benefit, in particular on the scope of the principle of formality and whether or not the request of the recipient so that birth occurs.

It also discusses "once more" the issue of prescription and forfeiture of the right to benefits, distinguishing the scope and effects of both figures.
