Abstract

The CJEU 12-12-2019 declared that the maternity allowance provided for in art. 60 LGSS (in its original wording) was contrary to Directive 79/7/EEC, in that it directly discriminated against men. Given the pre-eminence of EU law, the INSS should have complied with the doctrine of the Luxembourg Court. However, citing the absence of regulatory powers and its submission to the principle of internal legality, the managing body warned that it would continue to recognise the right to the allowance only for women who met the legally required conditions, as long as there was no legislative amendment. A criterion that was maintained until almost two years later, when the INSS finally reviewed its previous erroneous decision. Since then, the Supreme Court has had to respond to a multitude of legal disputes concerning the old maternity allowance and the alleged ‘discriminated male’.
