Abstract

The progressive abuse by the Courts on occupational accident's as a cause of the employee's injuries has led this concept to deform in a similar way as the "plastic collapse" on rigid materials. The Court's decision that will be analysed shows such a broad interpretation that even the injuries suffered by a worker while he is sleeping in a ship can be considered as an occupational accident. The aim of this paper is to study the technical arguments used with said purpose by the High Court when deciding on the further appeal for the doctrine unification on this case
