Abstract

In this article, we propose to make an analysis about the responsibility regarding the prevention of occupational risks that a head of household can assume when he undertakes the construction or reform of his house. For this, through the analysis of specific regulation, specifically the R.D. 1627/1997 for which the minimal safety and health regulations in construction are established, we will try to identify this person as required in the management of safety and health of the workers involved in the realisation of the construction.

Assuming its condition of security guarantor, we will concretize what are the obligations which are imposed on this head of household according to these regulations and we will approach the judicial doctrine that has analysed its responsibility, derived from an occupational accident.

Finally, we will offer some brief notes on the imputability of this subject in the different regimes of responsibility that can arise from an unlawful, regarding employment security and occupational health.
