Abstract

In an innovative way, the Supreme Court is gradually expanding the concept of an occupational accident ("numerus apertus") set forth in the General Social Security Act. In particular, the following are representative: 1. accidents that occurred whilst travelling to or from the place of work; 2. accidents in which the presumption of employment is debated; 3. the accident "in itinere" and 4. the accident "in mission". In this work, several flagship rulings of the former Supreme Court magistrate, Mr Aurelio Desdentado Bonete, are analysed in relation to the problematic figure of the work accident.
