Abstract

On the basis of the judicial criteria laid down by the Employment Division of the Supreme Court in its Sentence of 4 May 2015 (Rec. 1281/2014) "in which is reiterated the doctrine initiated primarily in its Sentence of 30 June 2010 (Rec. 4123/2008) and actually reflected in art. 96.2 Law 36/2011, of October 10, about the Social Jurisdiction", this scientific paper tries to show, in first place, the different theses that have been defended by the courts to declare the employer's civil liability in case of accidents at work and occupational diseases, and in second place, the main problems raised by the application of this civil liability to the temporary work agencies and user undertakings.
