Abstract

This article examines Advisory Opinion No. 31/2025 of the Inter-American Court of Human Rights, expressly requested by the Argentine State, through an integrative lens that articulates inter-American human rights standards with Argentina’s domestic legal framework on labor rights and women’s rights. Employing legal trialism as a methodological tool, the analysis incorporates insights from equality feminism to interpret state obligations through the prisms of non-discrimination, substantive equality, and protection against labor-based gender violence. The study reflects on the transformative potential of this Advisory Opinion –prompted by Argentina’s own initiative– for the national agenda, identifying opportunities for legislative reform, public policy development, and strategic litigation aimed at closing structural gender gaps in the world of work. It concludes that OC-31/2025 constitutes a landmark normative instrument that strengthens the justiciability of women’s labor rights and demands from the Argentine State an active, coherent, and intersectional implementation aligned with its role as the requesting party.
