Abstract

Two important Supreme Court decisions in this year again to resume the incidence surcharge performance on two aspects of particular relevance. The first one (STS March 4, 2015) discusses the possibility of extending the responsibility of the surcharge benefits from the defaulting company to the managing bodies. The second (STS March 23, 2015) represents a radical change of the position taken so far by the TS, admitting the option of transmitting surcharge social security benefits in case of default of corporate bonds of one company to another in cases of succession, provided that the unlawful conduct occurs at date prior to such subrogation.
