Requeriments for Access to the Active Reteriment Pension. Comment to the STS, Social, of May 30th 2017

The readjustment in the pension reform occurred in 2013 has introduced a new modality of retirement which allows to combine payment of 50% of the pension, caused by a Social Security regime in the Passive Classes System, with the performance of any activity, self-employment, full or part-time, in the private sector.
The enjoyment of this kind of retirement in lawfully submitted to the duty of a series of conditions and requirements that, despite the scant passing of time since its establishment, have caused a non-desirable litigiousness. That is what has happened, particularly, with the requirement of having the right to a pension that is equivalent to the one hundred per cent of the regulatory basis, in relation to which the Supreme Court have recently sentenced in a slightly problematic way, as it is shown in this work.Downloads
