EFRÉN BORRAJO DACRUZ (1928-2022): the construction of the Social Law of Labor and Social Security from “legal personalism”, realistic normativism and the “Living Law of Labour”

Abstract

Efrén Borrajo Dacruz was a great jurist who appropriately corresponds to the qualification of “classic of Social Law”. Some of its contributions have been decisive for the development of the discipline of Social Labour Law and Social Security. It cannot be ignored that Efrén Borrajo had a special affinity with the Social Security Law, of which he is recognized as one of the greatest growers. This assertion is easily sustained and demonstrated by taking into account its decisive contribution on the subject from the historical-legal approach to the analysis of general (and constitutional) theory of Social Security and culminating in the study (technical-legal and legal policy) of practically all the most relevant aspects of the legal regime of the Institutional System of Social Security and its Benefit System (protective action) in terms of completeness of treatment. And taking into account a very abundant production in the matter, the “Living Law” is characterized by precision, analytical rigor and constant attention in the dynamics of the Law, especially in its judicial realization.
